1. What PoolBook is

PoolBook is software that lets pool owners ("Owners") accept bookings for use of their private swimming pool by third parties ("Renters"). PoolBook provides booking infrastructure: a dedicated phone number, an automated voice menu (IVR), a calendar, a contacts list, voice-call reminders, and bookkeeping tools. PoolBook does not own or operate any pool, does not employ any Owner, and is not a party to the rental agreement between Owners and Renters.

2. Cash-only platform

PoolBook does not process renter payments and does not custody renter funds. All renter payments are made directly between the Renter and the Owner outside the platform (cash, Zelle, check, etc.). The "Accounting" feature inside PoolBook is a record-keeping tool only and does not move money. PoolBook charges Owners a subscription fee for use of the platform; that subscription fee is the only money PoolBook collects from anyone.

By booking a pool through PoolBook, the Renter acknowledges that pool use is at their own risk; that PoolBook is not the owner or operator of the pool; and that PoolBook is released from any liability for injuries or property damage occurring on or related to the pool premises. The Renter is responsible for paying the Owner directly.

5. Voice recordings and transcripts

The IVR records the Renter's spoken first and last name as part of the booking flow. The recording is stored on PoolBook's servers and made available to the Owner for identification purposes. PoolBook may automatically transcribe the recording into text using a third-party transcription provider (currently OpenAI). Recordings and transcripts are retained for the lifetime of the booking record.

6. Subscription

Owners pay a recurring subscription fee for use of the platform. Subscription fees are billed in advance through Stripe and are non-refundable. If a subscription payment fails, PoolBook may suspend the Owner's listing(s) until payment is brought current. Owners may cancel at any time through Stripe's billing portal; cancellation takes effect at the end of the then-current billing period.

7. Cancellation of bookings

Owners may cancel a Renter's booking at any time through the platform. Renters may cancel through the booking phone line or by contacting the Owner directly. Because PoolBook does not handle renter payments, any refunds between Owner and Renter are arranged directly between them.

8. Acceptable use

You agree not to use the platform to facilitate any unlawful activity, to harass other users, or to interfere with the platform's operation. PoolBook may suspend or terminate accounts that violate these Terms or that pose risk to other users.

9. No warranty; limitation of liability

The platform is provided "AS IS" without warranties of any kind, express or implied. To the fullest extent permitted by law, PoolBook's total aggregate liability to any Owner or Renter, for any claim of any kind, is limited to the subscription fees that the Owner has paid to PoolBook in the twelve (12) months immediately preceding the event giving rise to the claim. PoolBook is not liable for indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

Owner agrees to indemnify and hold harmless PoolBook, its operators, and its service providers from any claim or demand by any Renter, guest, or third party arising out of pool use, the condition of the pool premises, or the Owner's compliance (or non-compliance) with applicable laws.

11. Termination

Either party may terminate at any time. On termination, PoolBook may release any Owner's reserved phone number back to the carrier. Sections 4 (Renter responsibilities), 9 (Limitation of liability), 10 (Indemnification), and 12 (Governing law) survive termination.

12. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. The platform is offered to Owners and Renters across the United States; the choice of New Jersey law reflects PoolBook's place of business and is not a limitation on where the service may be used.

13. Changes

PoolBook may update these Terms from time to time. Material changes will be communicated to Owners by email or in-app notification at least thirty (30) days before they take effect.
